Child Support: When HR/Benefits Requirements Impact the Garnishment Department

When most employers think of child support, they focus on requirements for the payroll/garnishment department. However there are at least three specific situations in which other departments are involved. How HR, IT and Benefits handle their obligations does affect the garnishment department.

National Medical Support Notice (NMSN)

  • Both the employer (normally HR department) and the benefits administrator have a dual role when responding to the NMSN.  
  • Participants will learn basic requirements (HR) and Benefit Administrator must carry out and the overall affect in correctly handling the withholding limits when both cash support and medical support premiums are deducted.

New Hire Reporting 

  • Federal law requires employers to report their new hires within a certain timeframe.  Because new hires or at least the paper work for new hires is generally handled by the HR department, new hire reporting is initiated by HR in most companies.   However, this function is often turned over to IT to automate reporting.  You will learn:
  • What recent changes were made to the new hire reporting law.
  • What exposure your company has when reports stop generating.
  • What happens when mergers, acquisitions and sales of companies take place
  • Tips on how to prevent receiving non-compliance letters or being assessed penalties for improperly reporting.
  • How to simplify the reporting requirements.

  • Employers are continually bombarded with requests for employee personal data as well as information about benefits options from state agencies. Employers must notify the agency when an employee is terminated or resigns.

Notification when bonus, back pay awards and other lump sum payments will be made to employees subject to support orders.

  • Coauthor of the  Federal Office of Child Support Enforcement's The Employer's Desk Guide to Child Support.
  • Member and past chair of the APA Subcommittee for Child Support and the Subcommittee for Wage Attachments
  • Member of committees hosted by the federal Office of Child Support Enforcement , since 1995, to design the Order/Notice to Withhold, the Electronic Income Withholding Order, the Standard Verification of Employment Form and processes for electronically reporting lump sum payments. 
  • Appointed as an Advisor to the National Conference of Commissioners on Uniform State Laws (NCCUSL) to participate in a feasability study to standardize wage garnishment requirements at the state level.
