In this session of the 15th Annual National Asbestos Litigation Conference: Emerging Issues for the Most Active Jurisdictions in 2012, the presentation of technical evidence and its analysis by a jury are discussed. Observing this exercise may help you as you prepare for trial. This content is presented through a Bloomberg BNA and HB Litigation Conferences partnership.

In this session, two attorneys argue a cutting edge scientific issue before mock jurors, who render a decision in the matter. This is followed by a moderated discussion analyzing what the jurors really understood, the factors that played into their decisions and the questions that remained unanswered.

• Gain a better understanding of the relationship between evidence presentation and juror analysis of that evidence.
• Learn to present your case in such a manner that the jurors will better understand the issues and make a better informed decision.

Susan G. Fillichio, DecisionQuest (Moderator)
Ms. Fillichio is a trial consultant who specializes in trial strategy development, behavioral research and jury analysis. She focuses on understanding the perspective of the trier of fact to develop a simple and compelling story for the case. She assists clients in preparing for jury trials, bench trials and arbitration and her work has also served to assist counsel during mediation. Ms. Fillichio has provided consulting services in product liability, toxic tort and asbestos cases, intellectual property matters, construction and employment disputes, complex contract disputes and class action lawsuits. Regularly assisting counsel in jury selection in state and federal venues across the country, Ms. Fillichio is skilled in preparing witnesses for depositions, trials and arbitrations. Bringing over 23 years of experience in the legal profession to her understanding of juror behavior, she works with all members of the trial team to develop case themes and strategies. Known for client service, Ms. Fillichio is committed to finding the winning strategy and making trial preparation a smooth and insightful process. She leads the DecisionQuest research consulting team in Los Angeles and is a frequent speaker. Ms. Fillichio was recently nominated for The Los Angeles Business Journal’s Women Making a Difference awards as a Rising Star.

Prior to joining DecisionQuest, Ms. Fillichio was a partner with Morgan Lewis & Bockius LLP, Los Angeles, where she held a managing position in the Labor & Employment Practice Group. She has also practiced with national law firms in Chicago and New York. Over the course of her career as a practicing lawyer, she represented domestic and international clients in numerous matters before juries and arbitrators and in class action litigation. Ms. Fillichio has also completed internships with the Senate Labor Subcommittee (under Chairman Don Nickles, OK), for Representative Arlan Stangland (MN), and with the American Bar Association. She is proficient in French.

Ms. Fillichio earned a J.D. from De Paul College of Law in Chicago and a B.A. in English and Political Science from Indiana University.

Daniel R. Griffin, O’Connell, Tivin, Miller & Burns, LLC
Daniel Griffin is a partner in the law firm of O’Connell, Tivin, Miller & Burns, L.L.C. Mr. Griffin has earned a reputation among his peers as a tough litigator and no-nonsense lawyer. He carefully prepares each case and clients look to him for his common sense, practical approach to every aspect of a case. He is admitted to practice in jurisdictions across the country including the Trial Bar for the United States District Court for the Northern District of Illinois in Chicago. He has tried dozens of complex cases to verdict in jurisdictions across the county including Pennsylvania, Illinois, Delaware, Wisconsin and Georgia. Mr. Griffin has served as both national and regional trial counsel for many clients in hundreds of cases. Although primarily focused in the area of asbestos litigation and asbestos liability, Mr. Griffin has successfully counseled clients in a wide variety of legal matters including business torts, land use, licensing, wrongful termination of employment, municipal violations and property damage in state and federal courts throughout the nation. In addition to full-time private practice Mr. Griffin also enjoys volunteering at the Marquette University Volunteer Legal Clinic.

Mr. Griffin earned a J.D., cum laude, from Syracuse University, and B.A., with honors, from Purdue University.

Jonathan A. George, Waters, Kraus & Paul
Jonathan George is a partner at Waters, Kraus & Paul. Since 1985, Mr. George has focused his practice on asbestos litigation. He is licensed by the State Bars of Virginia, Texas, California, and Pennsylvania. He is also certified in civil trial advocacy by the National Board of Trial Advocacy. Mr. George was awarded both his bachelor's and his Juris Doctor degree from the College of William and Mary. While in law school, he was a member of the National Moot Court Team and served a third-year practice internship at the Office of the U.S. Attorney in Norfolk. He earned membership in the Order of the Coif by finishing in the top 10 percent of his law school class. Following graduation, he served as pro se law clerk for the U.S. District Court for the Eastern District of Virginia. Mr. George has tried numerous asbestos cases to verdict in Virginia, Texas, California, Washington State, and Ohio and has won many multimillion-dollar verdicts. He has been recognized for his pro bono work on behalf of Eastern Virginia Legal Services and was selected for inclusion on Thomson Reuters Virginia Super Lawyers® list in 2011. He served on the Board of Governors of the Virginia Trial Lawyers Association from 2000 to 2005 and is a frequent invited speaker for various professional organizations and continuing education seminars.

Mr. George earned a J.D. from the Marshall-Wythe School of Law, College of William & Mary, and a B.A. from the College of William & Mary.
