In this session from the 15th Annual National Asbestos Litigation Conference: Emerging Issues for the Most Active Jurisdictions in 2012, the faculty discusses defendants from “newer” asbestos cases and trial trends.

What does asbestos litigation currently focus on? What will it focus on in the future? Electrical components, non-traditional forms of exposure, how plaintiffs are framing the cases, and other products with potential exposure sources are all discussed.

Troy Chandler, Williams Kherkher
Troy Chandler practices with the Houston-based firm Williams Kherher, which specializes in mesothelioma and asbestos, personal injury, and defective pharmaceutical litigation. Prior to joining Williams Kherkher, Mr. Chandler was a partner with Baron & Budd, P.C. and a partner at a Houston based plaintiff’s firm. He graduated magna cum laude from the University of Houston and then earned a law degree from University of Houston Law Center, where he was Editor of the Houston Law Review, a member of the Order of the Coif, a member of the Order of the Barons and the recipient of the Dean’s Scholarship and Public Interest Law Fellowship.

Frank C. B. Friestedt, McGivney & Kluger, P.C.
Serving as the firm's director of both Pennsylvania and Delaware asbestos litigation, Mr. Friestedt has over twenty-five years experience in the practice of law as a litigator and as a manager of the defense of civil matters for clients on the local and national levels. After law school, Mr. Friestedt held a two-year judicial clerkship with Paul Ribner which involved him in criminal and civil trials ranging from homicide to complex corporate matters. Mr. Friestedt's private practice has focused on the litigation of consumer product liability, toxic tort and other complex litigation, including class actions and insurance defense. He has tried complex cases on behalf of automotive manufacturer clients, fire door manufacturers, construction product manufacturers and construction contractors. He has also defended class action litigation involving asbestos in buildings as well as spinal fixation devices in the drug and medical device fields. Mr. Friestedt is National Coordinating Counsel for a major manufacturer and marketer of expansion and pressure control products used in water systems and selected sectors of the HVAC market for commercial, industrial and domestic uses. He has served with National Counsel for a major automotive manufacturer and has served as Regional Counsel, and with National Counsel, for a national manufacturer of insulation materials. In these capacities, Mr. Friestadt has coordinated the defense of matters in diverse jurisdictions including Alabama, Arizona, California, Pennsylvania, New Jersey, New York, Massachusetts, Rhode Island, Florida, Louisiana, Texas, Illinois, Maine, Missouri, Mississippi, Maryland, South Carolina, Virginia, Washington, D.C., and British Columbia, Canada.

Mr. Friestedt earned a J.D. from Villanova Law School. He attended Simons Rock of Bard College and graduated magna cum laude from Elmira College in upstate New York. He is admitted to the Superior Court of Pennsylvania, the Supreme Court of New Jersey, the U.S. District Court for the Eastern District of Pennsylvania, and the U.S. District Court for the District of New Jersey.

Eliot S. Jubelirer, Schiff Hardin LLP
Eliot Jubelirer is a partner with Schiff Hardin LLP. He has varied and extensive experience in: toxic tort and product liability litigation; commercial litigation; legal malpractice litigation; and construction defect cases. He has tried numerous jury trials, court trials, and arbitrations to verdict. Mr. Jubelirer has successfully briefed and argued appeals in the U.S. Courts of Appeals for the Ninth and Sixth Circuits on behalf of an international shipping company, and numerous cases in California appellate courts on behalf of a variety of clients. One of his petitions to the California Supreme Court was featured in an article in the American Bar Association Journal. He is an adviser on a national level on toxic tort issues for clients involved in mass tort litigation. His practice includes construction and commercial litigation at the trial court and appellate levels. Mr. Jubelirer is a nationally recognized speaker on toxic torts, occupational lung injuries, and asbestos litigation.

Mr. Jubelirer earned a J.D. from the University of California, Berkeley, School of Law, where he was a member of the Order of the Coif and served as Research Editor for the California Law Review, and a B.A., with honors, from the University of Wisconsin — Madison, where mhe was Phi Beta Kappa.

Kerryann Cook, McGivney & Kluger, P.C.
Kerryann Cook is a partner and the Director of McGivney & Kluger’s New York City Asbestos Department. She primarily focuses her practice on the defense of asbestos/bodily injury cases, toxic torts, products liability and general casualty defense. She also maintains an active and diverse Sports & Entertainment Law practice. In addition to defending claims in New York, Ms. Cook’s practice includes developing defense strategies for various entities and coordinating their asbestos personal injury cases throughout the country. Shehas represented school districts, municipalities and private business in insurance defense, municipal law, negligence, construction/labor law and civil rights matters, in addition to having spent years working in and around collegiate and professional sports programs.

Ms. Cook earned a J.D. from the University of Memphis, an M.S. from the University of Tennessee, and a B.S. from Western Carolina University.

Hardship Policy
