Bloomberg BNA Publishes Update on Trademark Infringement Remedies

Bloomberg BNA has published the Second Edition of Trademark Infringement Remedies, a treatise that gives practitioners authoritative analysis of all aspects of trademark rights, liabilities, and remedies to protect the value of trademarks in both traditional and digital platforms, including social media.

In light of the rapid pace of new developments in the law, Trademark Infringement Remedies, Second Edition addresses every aspect of civil infringement remedies available today in federal and state courts. The treatise includes detailed analyses of federal, state, and common law remedies; thorough information on how to secure injunctive relief for clients and how to protect trademarks; complete coverage of the monetary relief available to trademark owners; and the full scope of available remedies, including attorneys’ fees, special enforcement remedies, state law remedies, remedies for counterfeit goods, and more.

The new Second Edition provides an overview of the law of trademarks and its developments and offers updates to most chapters, covering:

  • Necessary elements in establishing liability for trademark infringement and unfair competition
  • Principles for equitable relief and the impact of bad faith on a practitioner’s case
  • Issuance of preliminary and permanent injunctions
  • Possibilities and preparations for a wrongful seizure of another's goods in the area of “extraordinary” relief
  • Discussions about when, and under what circumstances, attorney’s fees may be obtained by either party in civil litigation
  • Availability of special enforcement remedies such as cancellations, disclaimers, and corrective advertising
  • Relief and remedies under state law for infringement and unfair competition
  • Special relief available in a counterfeiting case

The treatise was published in cooperation with the ABA Section of Intellectual Property Law. Section publications provide a balanced forum for the views and professional development of practitioners in intellectual property law.
