Bloomberg BNA Publishes New Supplement to “Health Care Fraud and Abuse”

Bloomberg BNA, in cooperation with the ABA Health Law Section, has published the 2012 Cumulative Supplement to Health Care Fraud and Abuse: Practical Perspectives, Second Edition, outlining in detail the existing fraud and abuse laws and regulations and offering the practical guidance practitioners need to protect their clients.

Health Care Fraud and Abuse: Practical Perspectives, Second Edition offers seasoned practitioners, as well as attorneys new to health care law, assistance in structuring acceptable business arrangements, avoiding statutory and regulatory pitfalls, defending clients, implementing effective corporate compliance programs, and more.

The 2012 Cumulative Supplement includes new material on legal developments applicable to Accountable Care Organizations (ACOs); recent Stark Law developments, including the Tuomey case and new regulations relating to the “whole hospital” exception; key revisions to the Prescription Drug Benefit Manual, which provide guidance for Part D plan sponsors on how to implement their legally-mandated, comprehensive fraud and abuse programs; new fraud and abuse developments in the area of clinical research; cases involving individual liability, particularly for directors, officers, and attorneys; and several key new False Claims Act (FCA) cases, including one where another court recognized the difference between conditions of payment and conditions of participation for FCA purposes.

The editor-in-chief of the 2012 Cumulative Supplement to Health Care Fraud and Abuse: Practical Perspectives, Second Edition is Linda A. Baumann, a partner in Arent Fox, where she specializes in health care fraud and abuse as well as compliance. This treatise is available for sale directly from Bloomberg BNA and also is available on the Bloomberg Law legal research system.

The treatise was published in cooperation with the ABA Health Law Section. Section publications provide a balanced forum for the views and professional development of practitioners in health law.
