• The 2009 revision to the Regulations, which implemented the 2008 amendments to the Act and made significant revisions to the prior Regulations, including revising Regulations that had been invalidated by the Supreme Court and courts of appeals; resolving disputes among the courts regarding whether employees can settle FMLA claims without DOL supervision; allowing employers to enforce their normal notice and procedural policies for employees using paid annual or personal leave for FMLA leave; and overhauling the previous notice and certification requirements and forms
