This program will focus on the onslaught of TCPA litigation and TCPA demands that companies are facing, explaining the key issues that are driving such claims (i.e., calls to a recycled telephone number; calls after the consumer has withdrawn consent).  Ms. Wahlquist will also discuss the already-apparent impact of the FCC’s July 2015 Order on allegations involving the TCPA.  Finally, the presentation will focus on defense strategies and on preventative measures that businesses seeking to communicate with their customers or prospective customers should consider taking before engaging in phone, text, or fax communications.

Ms. Becca Wahlquist has more than a decade of experience defending major companies sued under the Telephone Consumer Protection Act (TCPA), including acting as lead attorney for various Fortune 100 and Fortune 500 corporations facing potential damages in the sex to ten figures of liability exposure.  Her litigation experience includes several significant matters in the TCPA hotbeds within the Seventh, Ninth, and Eleventh federal circuits.  In addition, Ms. Wahlquist consults with major American companies about compliance with federal and state laws pertaining to telephone and text communications with consumers and prospective consumers.

Ms. Wahlquist is a partner at Snell & Wilmer LLP (2014 to present), where she founded the firm’s TCPA Practice Group.  Before that, Ms. Wahlquist was a partner at Manatt, Phelps, & Phillips LLP (co-chair of the TCPA Practice Group) (2010-2014), and a partner at Kirkland & Ellis LLP (2007-2010) after her associate years there (2001-2007).

Ms. Wahlquist is licensed in California, where she is admitted to all State and Federal courts, and also practices nationwide in Federal courts as lead counsel on various TCPA matters.  She earned her J.D., cum laude, from NYU School of Law, and Masters’ degrees from both UCLA and BYU in literature.
