Given the dramatic growth of e-commerce and social media, more and more copyrightable subject matter is posted on Internet websites by rights holders, licensors and by third-party users. Copyrighted works are also transmitted or retransmitted by Internet service providers.

The Digital Millennium Copyright Act (DMCA) includes notice and a takedown procedure and addresses content owners’ copyright management information. It also includes certain “safe harbors” for service providers and other provisions relating to secondary liability.

An understanding of the DMCA and copyright law principles is crucial for practitioners seeking to advise copyright owners, distributors of copyright content, and content users in an increasingly global economy.

Mike Remington is a partner in Drinker Biddle & Reath’s Washington, D.C. office, where his practice focuses on intellectual property law, legal reform and government relations. Prior to entering private practice, Mr. Remington held high-level positions in all three branches of the federal government. For thirteen years, he served as Chief Counsel of the Judiciary Subcommittee of the U.S. House of Representatives on Intellectual Property and Judicial Administration under Chairman Robert W. Kastenmeier and Counsel to the House Committee on the Judiciary. In the judicial branch, Mr. Remington served as a law clerk to U.S. District Judge John W. Reynolds and as Deputy Legislative Affairs Officer to the Judicial Conference of the United States under Chief Justice Warren E. Burger. In the executive branch, he was a prosecutor in the Criminal Division, U.S. Department of Justice.

Mr. Remington is a former Fulbright Scholar who also served for two years as a Peace Corps volunteer in Côte d’Ivoire, Africa. He has also been adjunct law professor at the George Mason School of Law and the Columbus School of Law, Catholic University of America, and has published numerous articles about copyright and patent law, among other legal subjects.

Mr. Remington earned his J.D., with honors, from the University of Wisconsin. He is admitted to practice in the State of Wisconsin and the District of Columbia.

Janet Fries, Drinker Biddle & Reath LLP
Janet Fries is Of Counsel with Drinker Biddle & Reath and also practices from firm’s Washington, D.C. office. Ms. Fries has represented numerous authors, artists, collectors, estates, art organizations, musicians, producers and Internet companies in connection with issues involving contract negotiation and preparation, website review, copyright and trademark protection and enforcement and related matters. She is fellow of the American Bar Foundation and serves in several positions with the American Bar Association, including Chair of the Copyright Division of the Intellectual Property Section, a member of the IP Law Continuing Legal Education Board, and a member of the Copyright Reform Task Force. Ms. Fries is a member of the board of directors of the Washington Area Lawyers for the Arts and Chair of the Arts and Cultural Law Committee for the Arts, Entertainment, Media and Sports Law Section of the District of Columbia Bar. She also co-teaches a course in Art Law at George Mason University.

Ms. Fries earned a J.D., with honors, from The George Washington University, an M.A. from San Francisco State University, and a B.A. from Smith College. Ms. Fries is admitted to practice in New York and the District of Columbia.

This program’s CLE-credit eligibility varies by state. Bloomberg BNA is an accredited provider in the states of New York*, California, Pennsylvania, Texas and Virginia, and most other jurisdictions grant CLE credit on a per-program basis. At this time, Bloomberg BNA does not apply directly to the states of Florida, Rhode Island, Montana and Hawaii although credit is usually available for attorneys who wish to apply individually. Additionally, the following states currently do not grant credit for Bloomberg BNA OnDemand programming: Arkansas, Ohio, Nebraska, and Delaware. All requests are subject to approval once the live webinar has taken place or the customer has viewed the OnDemand version.
