This webinar will focus on a remarkable range of new case law that has occurred in the first half of 2011 with respect to executive compensation, non-competition agreements, and ERISA litigation. Employers will hear about changes they could make to their ERISA plans and executive agreements in order either to protect against increased litigation risks or position to assert their rights under business protection agreements such as non-competes.

Eric Keller is a partner in the Paul Hastings Employment practice and represents clients in all aspects of executive compensation and employee benefits law. In this regard, he advises clients regarding tax, labor (including ERISA), financial accounting, securities, and litigation issues. He designs and prepares plan documents and participant communications, negotiates service-provider contracts, and assists clients in developing and operating efficient and prudent plan administration practices.

Mark Poerio is a partner in the Employment Law Department in the Washington D.C. office of Paul Hastings, and is a member of the American College of Employee Benefit Counsel. For 25 years, Mr. Poerio has been in private practice with a focus on executive compensation and employee benefit matters, especially from a business, governance, tax, and securities perspective. He works regularly and globally with every Paul Hastings office, and has significant pro bono representations relating to not-for-profit governance, executive compensation, and tax matters. Mr. Poerio is also an adjunct professor with the Georgetown Law School, where he designed and teaches both “Executive Pay and Loyalty” and “The Business and Securities Aspects of Executive Compensation.”

Henry Charles Eickelberg

Henry Eickelberg is currently General Dynamics Corporation's Vice President for Human Resources & Shared Services. At General Dynamics, he is responsible the corporation’s shared services center that performs a variety of payroll, payroll tax, travel expense reimbursements, and accounting functions. Mr. Eickelberg is also responsible for the design, administration, and compliance of General Dynamics' numerous defined benefit pension plans, 401(k) plans, and health and welfare programs. In addition, Mr. Eickelberg has oversight of the company’s occupational health and work-safety programs. In the area of mergers and acquisitions, Mr. Eickelberg has been directly responsible for the negotiating the benefits and administrative aspects of over 50 major acquisitions and divestitures that General Dynamics has conducted during Mr. Eickelberg’s tenure.

Mr. Eickelberg earned a B.S.C. in Accounting & Personnel Management from DePaul University and a J.D., with distinction, and an LL.M. from John Marshall Law School. He is a Certified Public Accountant in the State of Illinois and is licensed to practice law in the State of Illinois and the District of Columbia.
