Brian L. Hengesbaugh is a Partner in the Chicago office of Baker & McKenzie LLP where his practice covers privacy and information management, with emphasis on regulatory and transactional issues such as cross-border data flows, data security and breach notification obligations, whistle-blower hotlines, e-monitoring, e-discovery procedures, outsourcing, marketing, jurisdiction, consumer protection and other privacy-related issues. Mr. Hengesbaugh routinely works on sourcing and corporate transactions, global database and technology implementations, as well as privacy-related issues in litigation and government investigations.

Formerly a special counsel in the U.S. Department of Commerce, he helped develop and implement the U.S. government’s domestic and international policy in the area of privacy and electronic commerce. He received an award from the Commerce Department for his work in negotiating the Safe Harbor Privacy Arrangement with the European Union.

Mr. Hengesbaugh earned an A.B. from Washington University and his J.D. from the University of Minnesota Law School.

He is the co-author of Bloomberg BNA Privacy & Data Security Practice Portfolio Series No. 520, Cross-Border Data Transfers.
