David P. Henninger is Chair of Hooper, Lundy & Bookman’s Transactional Business Practice Group. Mr. Henninger represents private and public hospitals, physicians and medical groups, diagnostic centers, ambulatory surgery centers, pharmacies, medical equipment companies and other health care entities in all types of business transactions, including the purchase and sale of facilities, the preparation of private offering documents, the structuring of joint ventures, and contract negotiations. Mr. Henninger specializes in advising clients regarding a wide variety of regulatory issues, including anti-kickback and physician self- referral laws, public and private reimbursement, antitrust law, licensing and certification issues, and regulatory compliance programs.
Mr. Henninger began his legal career as in-house counsel for Dun & Bradstreet Healthcare Information Services, a consulting and management corporation specializing in the development and operation of managed care programs such as preferred provider organizations and health maintenance organizations. In addition to his corporate duties as in-house counsel, Mr. Henninger negotiated managed care contracts with hospitals and physicians in over fifty managed care networks across the country.
Prior to his legal career Mr. Henninger held a number of administrative and executive positions with the Maryland Department of Health and Mental Hygiene in health reimbursement and regulatory programs, including the Medicaid Program, licensing and certification, health planning and hospital rate-setting. In 1985 he served as Executive Director of Maryland’s state-wide health planning and certificate of need program.
Mr. Henninger received his B.A. from Bucknell University, his M.A. from the University of Maryland, and his J.D., with honors, from The George Washington University Law School.
He is a co-author of the Bloomberg BNA Health Law & Business Portfolio Series No. 2400, Federal Self-Referral Law.
