In this session from a full-day live conference of the same name, the faculty discusses the key issues that insurance providers must deal with in the aftermath of a major storm. They address flood exclusion, power interruption coverage, wind and other exclusions, sub-limits and deductibles, concurrent causation, and burdens of proof including indistinguishable damage issues.

Wystan M. Ackerman, Robinson & Cole LLP
Wystan Ackerman chairs Robinson & Cole’s Class Action Team. He has defended class actions in a variety of substantive areas and industries, including insurance, products liability, financial services, consumer contracts, and securities. Based in the insurance capital of Hartford, Connecticut, Mr. Ackerman's practice has a major focus on insurance. He writes the blog Insurance Class Actions Insider at www.insuranceclassactions.com and contributes to the blog Property Insurance Coverage Insights at www.propertyinsurancecoverageinsights.com, published by the firm's Insurance and Reinsurance Group. Mr. Ackerman regularly serves as national counsel for insurance companies in class actions, complex coverage litigation, and appeals. He currently represents insurance carriers in various putative class actions involving insurance coverage and market conduct/claim-handling practices. He has served on the defendants' steering committee and as a lead author of trial and appellate briefs on behalf of numerous insurers in high-profile class actions arising from Hurricanes Katrina and Rita, such as In re Katrina Canal Breaches Litigation (flood exclusion), the Louisiana attorney general's class action against the insurance industry involving the Road Home program, and the class action litigation involving the Louisiana Valued Policy Law.

Mr. Ackerman earned a J.D. from Columbia Law School, where he was a James Kent Scholar, notes editor of the Law Review, and on the Moot Court, and a B.A., summa cum laude, from Bowdoin College.

Jan A. Larson, Jenner & Block LLP
Jan Larson is a member of Jenner & Block’s Insurance Litigation and Counseling, Products Liability, and Environmental and Workplace Health & Safety Law Practices. She has broad experience representing corporate policyholders nationwide in disputes with their insurers and in complex litigation in both state and federal courts involving a variety of insurance claims, including first-party property damage claims arising under property damage policies, including business interruption coverage issues; third-party claims arising under comprehensive general Liability (CGL) policies; claims for damage to unique types of property covered by boiler and machinery policies; professional liability disputes arising under errors and omissions policies and directors’ & officers’ policies; employment practice disputes arising under employment practices liability policies; claims involving fidelity bond and financial institution bond coverage. Ms. Larson also has experience counseling policyholders with respect to insurance coverage placement and renewals.

Ms. Larson earned a J.D. from The George Washington University Law School, where she served as President of both the Mock Trial Board and the Law Association for Women, and an A.B. from Bowdoin College. She is admitted to practice in the Commonwealth of Virginia and in the District of Columbia and is an active member of the American Bar Association’s Insurance Coverage Litigation Committee.

Hardship Policy
