One California attorney says he may seek clarification on differing IRS guidance on tax-exempt organization political activity at the upcoming American Bar Association Section of Taxation meeting in Boston Sept. 13-15. Gregory Colvin with Adler & Colvin in San Francisco tells BNA in an email he will ask IRS to clarify discrepancies between two revenue rulings that present multiple-factor tests for determining whether communications (such as TV or radio advertising) by exempt organizations are public policy issue advocacy with no tax consequences, or instead political in character, with adverse tax treatment.
