Mr. Kennedy is a partner in Wiggin and Dana's Corporate Department and a member of the Information Technology and Outsourcing, and Privacy and Information Security Groups.  In 25 years of practice, Mr. Kennedy has focused on transactions and counseling in the law of information technology, data privacy and security, intellectual property and e-commerce. His transactional practice includes outsourcing, software development and licensing, e-commerce transactions, technology transfer and intellectual property-intensive M&A, divestitures, joint ventures and re-structurings. His clients have included Fortune 500 as well as emerging companies in the financial services, technology, communications, media, energy and consumer products sectors.  He received his B.A. (magna cum laude) from Carleton College, his M.A. from the University of Chicago, and his J.D. from Columbia University School of Law.

He is the author of Bloomberg BNA Corporate Practice Portfolio Series No. 106, Cybersecurity and Privacy in Business Transactions: Managing Data Risk in Deals.  This portfolio volume focuses on transactional risks encountered by attorneys, compliance officers and contract managers. It provides a practical overview of relevant laws and issues and how they arise in various types of commercial and corporate transactions, and why they can be critical business and legal risk management issues. The portfolio covers pre-contract considerations and explains the role of corporate due diligence in  managing data-related risk in transactions, and provides a comprehensive checklist and commentary on transactional due diligence inquiries involving privacy and cybersecurity. It also sets out key contract terms affecting the sharing of obligations and risk related to data privacy and cybersecurity.
