On June 26, 2013, in a 5-4 decision, the Supreme Court ruled that the Defense of Marriage Act violates due process and equal protection principles applicable to the federal government. The Court held that same-sex couples who are legally married are entitled to equal treatment under federal law and are entitled to share in the benefits and responsibilities that come with the federal recognition of their marriages.
Bloomberg BNA presented a webinar on June 28, 2013, that explained the impact of the Court's decision, particularly with respect to various forms of employee benefits. Topics that were covered included the impact of Windsor on qualified plans, welfare benefits, executive compensation, plan design issues and retroactivity issues. ERISA and employee benefits tax practitioners as well as Human Resource personnel and compensation professionals were encouraged to attend.
