The litigation over Leadership in Energy and Environmental design (LEED)-certified and other types of green buildings to date mostly has just nibbled along the edges of the true potential areas of dispute. One must understand what LEED is and what it is not to plan for a green building and receive delivery of the desired product as well as the desired performance over time. Both contracts and local legislation that simply require a certain level of LEED certification are hopelessly general and sage counsel should seek far more specificity when the decision is made to “green” a building.

In this 90-minute webinar, Stanley N. Alpert, a former federal chief environmental prosecutor and partner at Constantine Cannon LLP, will discuss:

  • Green building frameworks, including the meaning of LEED certification and alternatives such as Energy Star and zero energy buildings
  • Energy savings and other commercial advantages from green building
  • Overview of legislation at local, state, and federal levels
  • Litigation issues to date and problems to avoid, including contract or tort claims, loss of tax credits, and preemption issues
  • Contract drafting suggestions to ensure delivery of what is expected and to avoid litigation
