New BNA Portfolio Introduces Tax and Legal Issues Affecting Doing Business in Vietnam

Washington, DC (April 10, 2007) – BNA®, publisher of the authoritative and universally recognized Tax Management Portfolio series, has released the latest addition to its Foreign Income library. Portfolio 994, Business Operations in Vietnam, provides essential information for companies considering doing business in Vietnam—a country with a burgeoning economy and a shifting tax and regulatory landscape.

On the heels of Vietnam's successful bid to join the World Trade Organization, Business Operations in Vietnam examines the broad array of tax and legal issues affecting the business environment in that rapidly developing nation.  The authors provide expert analyses of the regulation of foreign investment, currency and exchange controls, trade and commerce regulation, immigration regulations, labor relations, and business financing.

A section on forms of doing business introduces Vietnam's Law on Foreign Investment (LFI) in the context of various business entities, including enterprises with 100% foreign capital, joint ventures, and many others.  The section on taxation introduces the Vietnamese tax system and analyzes some of the key tax issues facing businesses.  Also included are practical worksheets providing detailed information on the conditions for enterprise income tax incentives and illustrating specific registration forms and tax returns.

Fred Burke is a managing partner with Baker & McKenzie LLP's Vietnam offices. He has almost twenty years' experience in the planning, negotiation and operation of foreign investment projects as well as in the related issues of trade, securities, finance, construction, taxation, regulatory compliance, labor, intellectual property and technology transfer.  He is currently a Vice Chairman of the Executive Committee of Hong Kong Business Association in Vietnam, Co-Chairman of the Executive Committee of the Vietnam Business Forum and Senior Advisor, and Chairman of the Legal Committee of the American Chamber of Commerce in Vietnam. Mr. Burke obtained his Bachelor of Arts Degree with Honors from Stanford University, his Juris Doctor Degree from Columbia University School of Law and his Masters Degree of International and Public Affairs from Columbia University School of International Affairs.  He was admitted to practice in New York (1987) and Washington, D.C. (1988) and registered as a foreign lawyer in Vietnam since 1996.  Languages: English, Mandarin, Vietnamese, French, German and Italian. 

Nguyen Thanh Vinh worked for two international accounting firms for eight years before joining the Ho Chi Minh City office of Baker & McKenzie in 2004.  His principal practice areas are tax advice and planning, and foreign investment issues relating to licensing, labor, and finance.  Mr. Nguyen holds his Bachelor of Arts Degree in English from the University of Ho Chi Minh City and his LL.B. from the College of Law of Ho Chi Minh City.  He is fluent in English as well as his native Vietnamese.
