Arlington, Va. (March 23, 2009) – Driven by increased attention from the IRS and a Congress looking to introduce restrictive legislation, busy tax planners are scrambling to find an IRS-approved method for transmitting wealth at a low tax cost.  “Look to the impact of grantor trusts,” says BNA Tax & Accounting Portfolio author and University of Miami adjunct law professor, Jerry Hesch.  Hesch will be sharing his expertise in Competing Strategies to Transfer Wealth, a BNA audioconference on March 30th at 12:30 pm.

“Since many common transfer tax techniques use grantor trusts, the grantor's payment of the income taxes on the trust's income can have a far greater impact on tax savings than valuation discounts and rates of return greater than the Code's minimum rates,” says Hesch.

By analyzing the impact of grantor trust status on outright gifts in trust, GRATs, installment sales, private annuity sales, SCINs and CLATs, and sensitizing the tax advisor to factors often ignored, estate planners can best choose the appropriate strategy for a particular client.

Participants will learn the following:

  • Shifting more wealth free of transfer taxes: grantor trust status vs. valuation discounts vs. estate freezes
  • Continuation of grantor trust status in the long run
  • Techniques
  • Gifts to irrevocable trusts
  • GRATs
  • Installment sales to grantor trusts
  • Private annuity sales to grantor trusts for healthy individuals
  • SCIN sales to grantor trusts
  • Charitable lead trusts
    1. Inter vivos CLATS
    2. Testamentary CLATS
    3. What powers can be used to create a grantor CLAT
  • The credit shelter trust for the benefit of the surviving spouse
  • Communicating Complex Tax Planning Techniques Simply
  • A spreadsheet analysis
  • Comparing the results of the alternative techniques
  • Satisfying the five minute test

Harold W. Pskowski, BNA’s senior tax analyst on Estates, Gifts and Trusts, seconded the importance of understanding the role of grantor trusts in effective estate planning: “With increased IRS attention to valuation discounts and the likelihood that Congress will restrict discounts through legislation, tax planners should review their options carefully.”
