Main Volume Information

One of the biggest problems facing trademark attorneys who deal with selecting new trademarks, prosecuting trademark applications in the PTO, or litigating trademark rights is determining whether a client’s mark used to identify a particular product might be “confusingly similar” to another mark used to identify other products. BNA Books’ Products Comparison Manual for Trademark Users is the only desktop reference that guides practitioners through the Trademark Trial and Appeal Board's (TTAB) and the courts' findings on similarity of products for trademark uses—and it has been for more than two decades. This handy reference covers 81 years of Board decisions and lets you search most of them electronically with an accompanying CD.

Products Comparison Manual for Trademark Users, Second Edition contains more than 60,000 product comparisons by the courts and TTAB, covering the decisions since 1929. Included in the book are citations for every comparison, so decisions can easily be found on the PTO website or in BNA's U.S. Patents Quarterly.

1,000’s of New Listings Since the First Edition! Access the Decisions on the Web!

Product comparisons from the book are provided on an accompanying CD-ROM, allowing you to search these comparisons electronically and linking you, in most cases, to the full text decisions either on the USPTO’s TTAB Decisions web page or, for BNA subscribers, BNA’s IP Library on the web.

Complete Analysis

To help practitioners do the most complete search possible of similar products, the authors have analyzed the findings of the courts and/or the Board in order to impose editorial uniformity on the descriptions of products listed in the cases and have assigned U.S. Class numbers to each product. The products are then aggregated by Class number so that users can more easily find synonymous product terms and closely similar products.

Simplified Research

Products Comparison Manual for Trademark Users is a convenient and readily accessible source of data that will be useful in trademark infringement proceedings and for trademark registration matters. This data will permit the user to identify and locate virtually all decided cases which have compared products of interest to the user, with other products for trademark purposes. Citations are provided for all such cases.

Supplement Information

The 2011 Cumulative Supplement covers TTAB proceedings for 2007–2010 and contains thousands of new product comparisons. The accompanying CD fully incorporates the new data into the Second Edition, giving you one seamless data file spanning 82 years of TTAB action. This exemplary resource will greatly simplify and expedite your research by product, citation, or holding of the board.
