The long-running disputes over enforcement of the Clean Air Act’s New Source Review program were finally aired in the U.S. Supreme Court, but were they really resolved?  The court’s March XX opinion in Environmental Defense v. Duke Energy likely will impact issues of jurisdiction to challenge agency actions, the government’s ability to “interpret” regulations outside of rulemakings, construction planning by facility owners, and enforcement actions.
