With the re-election of the Obama administration and the U.S. Equal Employment Opportunity Commission’s heightened focus on sex discrimination and harassment in employment, including discrimination based on sexual orientation and transgender status, employers must be knowledgeable and vigilant. They need to be up to date on the laws regulating sex discrimination and harassment and informed on how best to handle allegations arising from these potentially costly situations.

This webinar will focus on educating employment law practitioners and human resources professionals on recent developments in the law of sex discrimination and sexual harassment, including transgender issues in employment, under Title VII of the Civil Rights Act and state anti-discrimination laws. Join speaker Nathan A. Schacht, an employment law attorney at Baker & Hostetler LLP, as he discusses the following:

•Trends in filings with the EEOC and lawsuits filed by the EEOC and the Obama administration’s stated objectives.
•The EEOC process for reviewing sex discrimination and sexual harassment charges, including court decisions on what can constitute a charge and meet the agency’s conciliation requirements prior to the filing of a lawsuit.
•The legal standards and definitions applied by the courts for quid pro quo and hostile work environment sexual harassment claims and for sex discrimination claims.
•A review of recent cases in which particular conduct was found to meet the threshold standard for moving a claim beyond summary judgment and cases in which conduct did not meet the threshold.
•Same-sex/sexual orientation harassment.
•Recent developments concerning employer liability issues.
•Future of federal protection for transgender individuals in the workplace.
•Status of proposed federal Employment Non-Discrimination Act (“ENDA”).
•A review of recent EEOC and federal court decisions determining that discrimination based on transgender status is unlawful sex discrimination under Title VII.
•Trends in state and local anti-discrimination laws.
•Strategies in avoiding liability, including use of “love contracts.”
