The 2012 presidential race has put sexual harassment back into the national spotlight. Past accusations against one candidate in particular have refocused the public on what constitutes sexual harassment, who may allege it, how charges are processed by the Equal Employment Opportunity Commission, and the end results of sexual harassment claims in settlements and litigation.

This webinar will focus on updating employment law practitioners on recent developments in the law of sexual harassment, including under Title VII of the Civil Rights Act and state anti-discrimination laws. Join speaker Holli Hartman, Counsel, Baker & Hostetler LLP, as she discusses the following:

  • Trends in filings with the EEOC and lawsuits filed by the EEOC, including pattern or practice/class action cases.
  • The EEOC process for reviewing sexual harassment charges, including court decisions on what can constitute a charge and meet the agency’s conciliation requirements prior to the filing of a lawsuit.
  • The legal standards and definitions applied by the courts for quid pro quo and hostile work environment sexual harassment claims.
  • A review of recent cases in which particular conduct was found to meet the threshold standard for moving a claim beyond summary judgment and cases in which conduct did not meet the threshold.
  • Same-sex/sexual orientation harassment.
  • Employer liability issues.
  • Settlement amounts and jury verdicts reached in 2011.
  • New evidentiary issues, including issues related to social media.
  • Trends in state and local anti-discrimination laws.
  • The impact of AT&T Mobility v. Concepcion on the arbitration of sexual harassment claims.
  • Strategies in avoiding liability.
