    The Pennsylvania Environmental Quality Board recently amended the state’s stormwater management and erosion and sediment control requirements. Under the amendments, persons responsible for activities regulated under the state’s Stormwater Management Act of 1978 must develop, implement, and maintain a post-construction stormwater management plan that seeks to better limit erosion and sediment-laden runoff following land-disturbing activities. The state also incorporated federal Phase II stormwater requirements applicable to construction activities. The amendments took effect Nov. 19.

    The federal Environmental Protection Agency’s Phase II stormwater regulations extended requirements under the National Pollutant Discharge Elimination System permitting program to construction activities that disturb one or more acres of land. Previously, only sites that disturbed more than five acres of land alone or as part of a larger development project required permit coverage. The Phase II regulations, which were issued in March 2000, seek to minimize the amount of polluted runoff from construction sites, among other things. In December 2009, EPA issued effluent limitation guidelines for construction and development that set non-numeric best management practices for sites that disturb one or more acres and established daily average turbidity limits for sites that disturb 10 or more acres. The agency is in the process of revisiting that rule based on a reinterpretation of the data used in setting the limits.
