New FATCA Foreign Financial Assets Reporting, Form 8938, and Updated Foreign Bank Account Reports, TD F Form 90-22.1: Seeing Double? No!
Arlington, VA (December 5, 2011)  New FATCA foreign financial assets disclosure rules require reporting that, at first blush, looks like FBAR reporting. But this is a whole new set of tax reporting rules that in many (if not most) cases will overlap and duplicate the Bank Secrecy Act (FBAR) rules. The FATCA disclosure rules are found in new section 6038D, which underpins new IRS Form 8938 (Statement of Certain Foreign Financial Assets). These rules are effective for taxable years beginning after March 18, 2010. Taxpayers affected will need to file this form for first time with their 2011 federal tax returns! New BNA Webinar Prepares Tax Practitioners While IRS Form 8939 Deadline Looms.

Arlington, VA (November 22, 2011) The IRC Section 1022 Election to elect out of the federal estate tax and into the modified carryover basis regime for persons dying in 2010 must be made on a timely-filed Form 8939, Allocation of Increase in Basis for Property Acquired From a Decedent, not later than January 17, 2012. No extension of time to file this election will be permitted.

Circular 230 Amendments Spell Significant Changes for Tax Practitioners

On August 2, 2011, the latest amendments to Treasury Department Circular 230 took effect. Every subpart – authority to practice, practice before the IRS, disciplinary proceedings, sanctions, and general provisions – were affected. 35 rules were changed and one rule added. Circular 230 now consists of 60 rules, 60% of which are in some way new.

Tax Experts Discuss Foreign Bank Account Report Developments and Overlapping FATCA Disclosure Requirements in New BNA Webinar
U.S. citizens, residents and certain defined entities that have a financial interest in or signature power over foreign financial accounts must file a Financial Bank Account Report (FBAR) if the aggregate value of the accounts exceeds $10,000 at any time during the calendar year. While this is not new, the Treasury Department recently published new final FBAR regulations, the IRS published a new FBAR form, followed with detailed instructions for answering questions relating to filing FBARs.
