The Fair Labor Standards Act and state wage and hour laws require employers to include all hours worked when computing overtime compensation. Employees’ total hours include all time spent doing work for employers, including time spent traveling on behalf of employers. The computations can be complex and confusing, even for experienced payroll professionals.

Different rules apply for commuting, traveling away from employees’ tax homes, and local travel between work locations. Rules also vary based on whether employees are driving company or personal vehicles, traveling via public transportation, or whether they are exempt or non-exempt workers.
