Vapor intrusion has become an issue that must be considered by any party involved in the cleanup, redevelopment, or purchase of previously contaminated property. Regulators have stepped up their scrutiny of sites where, due to risk-based cleanups, contamination remains in place, even when final approval of the cleanup has been given. This has resulted in the reopening of sites that were previously cleaned up and closed, creating increased uncertainty for owners of such sites. Furthermore, vapor intrusion has spurred increased litigation with property owners claiming such vapors have impacted their health or property values. As such, vapor intrusion has become a game changer and must be addressed by a skilled team of legal and technical professionals adept at identifying and implementing proper methods for assessing and addressing potential or identified vapor intrusion risks.

Dr. Blayne Hartman and Lawrence P. Schnapf

Dr. Blayne Hartman is president at Hartman Environmental Geoscience. He co- founded H&P Mobile GeoChemistry, a business partnership offering on-site laboratory analysis, direct push environmental sampling, soil vapor surveys, and vapor intrusion services, and currently is an independent consultant offering vapor intrusion and soil gas support. Hartman is a nationally recognized expert on soil vapor sampling, soil vapor analysis, and vapor intrusion. He has provided training on soil gas methods and vapor intrusion to county and state regulatory agencies in more than 30 states, many of the EPA regions, the DOD, and numerous stakeholder groups and consultants. He has written numerous articles on the collection, analysis, and interpretation of soil vapor data, including chapters in four textbooks. He has participated in technical workgroups on soil vapor methods for EPA, CA-EPA, CA Regional Water Boards, County of San Diego, ITRC, and ASTM and reviewed/edited instructional manuals for the EPA OUST and superfund groups. Over the past four years, Hartman has been a contributing author/editor to vapor intrusion and soil gas guidance documents to federal EPA, CA-EPA, San Diego County, ITRC, DOD, API, and more than 25 individual state documents. He currently is a trainer in the EPA-OUST, ITRC, ASTM, and API vapor intrusion courses. He received his Ph.D. in geochemistry from the University of Southern California.

 

Lawrence P. Schnapf is an environmental attorney based in New York City and New Jersey with more than 25 years of national environmental experience and is the principal of Schnapf Environmental Law Offices. Schnapf primarily concentrates on environmental issues associated with corporate, real estate and brownfield transactions; commercial financing including asset-based lending, syndicated loans, mezzanine loans and distressed debt; bankruptcy, workouts and corporate restructuring. He has extensive experience with brownfield redevelopment and financing, including representing affordable housing developers and assisting local development corporations or not-for-profit organizations with their brownfield planning programs. Schnapf also counsels clients on environmental, represents clients in federal and state environmental litigation, enforcement actions, administrative proceedings and private cost recovery actions. He has also served as liaison counsel for PRP steering committees. He has also written numerous articles on environmental law, is a contributing author for several chapters of Brownfield Practice and Law: The Cleanup and Redevelopment of Contaminated Properties published by Matthew Bender. He was also a contributing author for The Law Of Environmental Justice published by the American Bar Association and the Matthew Bender Environmental Law Practice Guide. He is also the author of Managing Environmental Liability in Transactions and Brownfield Redevelopment published by JurisLaw Publishing. Schanpf is the co-chair of the New York State Bar Associations Hazardous Site Remediation Committee, co-chair of the NYSBA brownfield task force and a board member of the Board of the NYC Partnership of Brownfield Practitioners. He is also the chair of the BrownfieldCommitteeForce of the Environmental Business Association of New York. He is Chair of the ABA Section of Business Law Committee on Environmental, Energy and Natural Resources Law. He is a vice chair of the Environmental Transactions, Audits and Brownfield Committee; and Special Committee on Disclosure of the ABAs Section of Environment, Energy and Resources.
