When Are Workers Employees: And Why Does It Matter?

Tax and other laws vary significantly depending on how a worker is classified. Employees, unlike most other types of workers, are protected by labor laws and their wages are subject to employment tax and withholding, making their services potentially more costly than services provided by other classes of workers, such as independent contractors. In a challenging economy, it is tempting to reduce labor costs by paying employees 'off the payroll.' Governmental agencies, particularly the Internal Revenue Service and state and local taxing authorities, are now cracking down on worker misclassification, causing employers to carefully review their policies and practices.

Join  Debera Salam, CPP, Director of Payroll Information and Process Services for Ernst & Young LLP, as she provides a complete review of the issues and considerations involved when making worker classifications, including:

  • The classes of workers and the tax and reporting that apply
  • What is an employee
  • What is a statutory employee
  • What is a statutory nonemployee
  • What are leased and temporary employees
  • The factors indicating employee status under various laws
  • Classification audits, consequences and voluntary disclosure
  • Viable options for controlling labor costs
