Jerry Cohen is a Partner with Burns & Levinson LLP in Boston who has more than 40 years experience as a lawyer dealing with patent, copyright, trademark, unfair competition, licensing/franchising, visual arts, software, databases and publication law, formation and operation of business enterprises and not-for-profit organizations, international trade, litigation/ADR, and legal ethics. Mr. Cohen handles acquisition, licensing and litigation of intellectual property rights. He has also served as an expert witness, arbitrator and mediator in intellectual property matters.

Prior to joining Burns & Levinson LLP in January 2006, Mr. Cohen was a partner with the firm Perkins Smith & Cohen LLP.

Mr. Cohen earned his undergraduate degree from the Rensselaer Polytechnic Instituteand his J.D. from the George Washington University.

He is the author of Bloomberg BNA Corporate Practice Portfolio SeriesTrademarks and Related Unfair Competition.  This portfolio volume explains in detail the process of securing and maintaining a federal trademark registration. Beginning with a discussion of the types of trademarks, the emphasis in this portfolio is placed on the trademark selection procedure, including counsel's role in the process, and trademark searching for anticipations. This discussion deals with the preliminary screening of proposed marks and both domestic and international trademark word searches. It also goes on to describe: the perfection of legal interests in trademarks, including the federal registration application and follow-up procedures; the protection of legal interests in trademarks, which involves the resolution of disputes through negotiation, court or administrative proceedings; and the necessity of establishing a trademark maintenance program. Also discussed are related unfair competition issues, including Section 43(a) of the Lanham Act, the transfer of property (trademark) rights and the impact of the Internet on trademark practice.
