Everyone knows that data breaches are increasing exponentially.  And so are the laws and lawsuits pertaining to the breaches.  This expansion impacts in-house counsel in a substantial way, regardless of the size of their businesses.  The key question faced by in-house counsel is: how do I protect the business and stay abreast of the changing laws?

Answering this question may seem overwhelming, but it is not.  There are specific tangible measures that every business should have in place in order to reduce the risk of data breaches.  These measures fall under the critical umbrella of data governance, and they include: (a) developing and implementing corporate policies governing the protection of data; (b) monitoring and auditing compliance with those policies through various measures including state-of-the-art software; (c) exploring the prospects of purchasing cyber insurance, which is increasingly necessary and affordable; (d) creating and testing an incident-response plan; and perhaps most important, (e) training all professionals and employees so that they know how to follow the rules.

There also are specific tangible steps that every business should follow after a data breach.  The first step is to contact your insurer (if you have one) or your counsel.  This will help ensure that your remediation efforts are protected by the attorney-client privilege.  There are additional post-breach measures that this webinar will discuss, including compliance with statutory notification requirements, forensics analyses to stop the bleeding, and preparations to work with (or perhaps defend against) potential plaintiffs and regulators.  The objective of this program is to help audience participants to go back to their businesses and put sound best practices in place to protect their operations and reduce risks from a perhaps-inevitable breach.
