The Securities and Exchange Commission's latest guidance makes it clear that the relaxed and casual environment that is so characteristic of social media platforms, and certainly one of the reasons for its astonishing growth, does not translate well to the strict disclosure obligations imposed on public companies, the authors write. Nonetheless, the SEC has made clear that social media can be a valuable and useful tool for disseminating company information, if properly managed.
