‘High Win-Rate’ for States Supported by Multistate Tax Group

States have been successful in several cases in which the Multistate Tax Commission has filed friend-of-the-court briefs, according to MTC staff.

An Aug. 1 report addressed to the Litigation Committee noted that since March 2015, the MTC has filed 13 briefs for 11 different states. The report further highlighted 17 cases in which the MTC has filed briefs.

“Although the Commission doesn’t claim the credit for it, the overall ‘win rate’ is high,” according to the report.

“The Commission’s legal staff spends 15 to 20 percent of their time on appellate-related activity, primarily drafting amicus briefs,” Helen Hecht, MTC general counsel, told the committee Aug. 1 during the MTC’s annual meeting in Louisville, Ky.
