August Horvath is a partner in Kelley Drye & Warren LLP's New York office. He focuses his practice on advertising law and antitrust matters. Mr. Horvath represents clients in private false advertising and deceptive practices litigation before the Federal Trade Commission's (FTC) Consumer Protection Bureau and the National Advertising Division (NAD) of the Council of Better Business Bureaus, and in courts around the country. Mr. Horvath’s antitrust experience includes litigating both civil and criminal cases before the Department of Justice (DOJ) Antitrust Division; FTC investigations and litigation related to conduct and mergers and  acquisitions; self-regulatory challenges before the NAD and network advertising clearance services; and private litigation, including class actions with millions of class members.  He received his B.A. from the University of Windsor, Ph.D. from the University of Southern California and J.D. (cum laude) from Harvard Law School.  He is a member of the New York Bar and American Bar Associations.

 

Mr. Horvath is co-author of Bloomberg BNA Corporate Practice Portfolio Series No. 32-4th, Trade Associations and the Antitrust Laws.  This portfolio volume summarizes the Sherman, Clayton and Federal Trade Commission acts as they apply to trade associations. It further analyzes those aspects of antitrust law most likely to be applied to trade association activity, including such subjects as price fixing, statistical reporting programs, membership restrictions and the availability of association services to nonmembers, codes of ethics and disciplinary proceedings, standardization and certification programs, joint research projects, lobbying and group buying.
