Instagram Joins Photographer’s Alleged Infringers List


A fine art photographer has added Instagram LLC to a growing list of companies she says have infringed one of her copyrighted photographs.

Photographer Jennifer Rondinelli Reilly alleged that at least one Instagram user posted her copyrighted image—of red lips and a microphone—on the social networking site.  Reilly notified Instagram of the infringement pursuant to Section 512 of the Digital Millennium Copyright Act, 17 U.S.C. § 512. But Instagram failed to remove the infringing image, she alleged.

Instagram and counsel for Reilly didn’t respond to requests for comment by press time.

Instagram is not alone. Reilly has sued Twitter Inc., BuzzFeed Inc., online magazine Four El Magazine LLC, event website operator Plot Commerce and media company 614 Media Group Inc. for the publication of several other of her copyrighted photos.

Reilly won a default judgment against Plot Commerce March 11 and settled with Four El Magazine.  She voluntarily dismissed the case against Twitter Feb. 23. Time will tell how the Instagram case shakes out, and if any more companies fall under Reilly’s radar for infringement.
