President Donald Trump announced Jan. 31 that Neil Gorsuch, a judge on the U.S. Court of Appeals for the Tenth Circuit, would be his nominee to fill a vacancy on the U.S. Supreme Court.

According to McManus and McLoughlin, Gorsuch’s ascension to the high court could result in further limiting the Internal Revenue Service’s rulemaking leeway when the agency is already defending rules against corporate inversions and transfer pricing rules that arguably weren’t authorized by the tax code.
