July 22 — Trump International Hotel Las Vegas settled two unfair labor practice complaints issued by a National Labor Relations Board official alleging the company took actions to discourage employees from engaging in union activities, two unions announced July 21.
According to a consolidated complaint issued March 2 by Cornele A. Overstreet, the Phoenix-based regional director of NLRB's Region 28, the hotel's labor consultant told employees it would be futile for them to select UNITE HERE affiliates Culinary Workers Union Local 226 and Bartenders Union Local 165 as their bargaining representative because it wouldn't help them.
The consultant, Juan Cruz, also promised hotel employees more opportunities to transfer to different positions if they abandoned their support for the union.
In addition, the hotel reduced the work hours of union organizer and hotel employee Michael Campus, and subsequently fired him, the complaint said. Managers also failed to grant Alma Zamarin, another employee and union supporter, a transfer to a full-time server position.
The hotel's actions violated sections 8(a)(1) and 8(a)(3) of the National Labor Relations Act, the complaint said.
The settlement, which a hotel representative signed June 20, provides for the hotel to reimburse Zamarin and Campus $1,500 and $9,700, respectively, primarily in back pay.
The hotel also agreed to post for 60 days in prominent places in its Las Vegas facilities notices about the settlement agreement, and employees' federal rights to form, join or assist a union.
A hearing before an administrative law judge of the NLRB had been set to begin June 14, the union said.
“While we were eager to go to trial to prove that Donald Trump’s hotel broke the law, this settlement is a great victory for his employees whom we contend suffered discrimination because of their union activity and support,” Geoconda Arguello-Kline, secretary-treasurer for the culinary union, said.
Amanda Miller, a spokeswoman in New York City for the hotel, wasn't available to comment July 22.
Culinary Workers Union Local 226 and Bartenders Union Local 165 are Nevada affiliates of UNITE HERE, which represents 270,00 workers in the gaming, hotel and food service industries.
The culinary and bartenders unions represent casino and other workers in Las Vegas and Reno, Nev., and are the collective bargaining representative for more than 500 workers at the Trump hotel.
