This program explores the different types (and approaches) of various mediation providers in the realm of eDiscovery, i.e., court-appointed mediation specialists, on-line mediation providers and both volunteer and paid mediators.  The panel’s presenters will reveal, in all its potential efficacy and creativity, this significant form of, arguably, critically needed “Alternative Discovery Resolution” and the manner in which mediation can be best utilized in eDiscovery in the areas of needs assessment, discussion facilitation, negotiation structuring, motions screening, neutral evaluation of disputes, search facilitation, and other vital areas of the discipline.

• The manner in which attorneys and practice support professionals can resolve eDiscovery disputes in a more rapid, more non-confrontational and often decidedly more efficient manner, utilizing the intervention of 3rd parties and the use of relatively non-conventional vehicles for discover compromise;

Mr. Robert Eisenberg is a Strategic Consultant at Complete Discovery Source (CDS) and Director of eDiscovery & Information Governance at Larson Security LLC.  He has in-depth experience in the rendering of consultative services relating to the discovery of electronically stored information, computer forensics, proactive electronic data preservation and retention and data security.  He is the Founding Chair of Georgetown Law Center’s Advanced eDiscovery Institute, widely recognized as the nation’s premier eDiscovery CLE program.  He frequently conducts seminars, CLE courses, and other presentations on the subjects of eDiscovery, Computer Forensics, and Electronics Records Management.  Mr. Eisenberg is a member of Bloomberg BNA’s eDiscovery Advisory Board.
